It is not only suspects who have rights and obligations in an investigation following a workplace incident, witnesses do too.
In accordance with the professional rules governing the conduct of solicitors, it is rarely appropriate for a suspect’s solicitor to advise or represent those whom the authorities view as witnesses. In the regulatory context, following a workplace incident, these rules apply such that witnesses from whom the regulator wishes to extract information or a statement will require advice from a solicitor other than the one representing their employer.
